What is the transition payment upon dismissal?

Upon termination of the employment contract at the employer's initiative or upon mutual termination, the employer must pay a transition payment. Since the Work and Security Act (WWZ) of 1 July 2015, this financially supports the search for a new job or further training. In Utrecht, this is often seen with local companies. The payment depends on years of service and salary and can exist alongside other arrangements.

Statutory basis: Article 7:673 BW

Article 7:673 of the Dutch Civil Code obliges the employer to pay upon dismissal by the employer itself or upon settlement agreement (unless the employee took the initiative). The calculation is based on length of service and salary, with exceptions. For employment periods up to 10 years, a different formula applies than above that, for a fair build-up.

Basic formula

First 10 years: 1/6 × monthly salary × months

From the 11th year: 1/4 × monthly salary × months (from month 121)

Max. €94,000 gross or annual salary (if higher).

Calculation examples

Example 1: 5 years of service

Monthly salary €3,000, 60 months: 1/6 × €3,000 × 60 = €30,000 gross.

Example 2: 15 years of service

Monthly salary €3,000, first 120 months: 1/6 × €3,000 × 120 = €60,000
Remaining (180 months total): 1/4 × €3,000 × 60 = €22,500
Total: €82,500 gross.
