The PIJ measure, also known as youth TBS, is the strictest sanction within juvenile criminal law and comparable to TBS for adults. This measure is imposed on young people who commit serious offenses and have a mental or developmental disorder.

What does the PIJ measure entail?

PIJ stands for Placement in an Institution for Juveniles. It is a treatment-oriented measure for young people who have committed a serious crime and for whom a mental disorder or developmental problem has been established.

Conditions for imposition

  • Age between 12 and 23 years at the time of the offense
  • Serious punishable offense (with a minimum sentence of 4 years)
  • Presence of a mental disorder or developmental problem
  • Risk of repetition of punishable offenses
  • Interest of the safety of others or society

Duration of the measure

The PIJ measure has a standard duration of 3 years. Extension is possible in periods of 2 years, with a maximum of 7 years. In exceptional cases, the measure may transition to adult TBS.

Implementation of the measure

The implementation takes place in a Judicial Youth Institution (JJI). Young people undergo an intensive treatment program that focuses on:

  • Addressing the mental health issues
  • Reintegration into society
  • Reducing the risk of recidivism

Difference from juvenile detention

While juvenile detention is a punishment with an emphasis on retribution, the PIJ measure is focused on treatment. As a result, the duration of PIJ can be longer than the maximum juvenile detention.

After completion of the measure

Upon termination of the PIJ measure, conditional release may follow, whereby the young person is under probation supervision and must comply with certain conditions.

Frequently asked questions about PIJ in Utrecht

When is a PIJ measure imposed?

A PIJ measure is imposed on young people aged 12 to 23 who have committed a serious offense (with a sentence of at least 4 years), have a mental disorder, and pose a risk of repetition. The court determines this with regard to public safety.

How long can a PIJ measure last?

The measure starts with a duration of 3 years and can be extended by 2 years each time, up to a maximum of 7 years. In extreme cases, conversion to TBS may follow.

How does PIJ differ from juvenile detention?

PIJ focuses on treatment of mental health problems and prevention of recidivism, while juvenile detention is a punishment. PIJ can therefore last longer than the maximum juvenile detention of 2 years.

What happens after the PIJ measure?

After completion, the young person may be released on parole under the supervision of probation, with strict conditions such as therapy or reporting requirements.

Can a PIJ measure end earlier?

Yes, if the treatment is successful and the risk of recidivism is low, the court may decide to terminate the measure prematurely, often with conditional release and aftercare.
