Emergency Leave in Utrecht: Maximum Duration and Rules

Emergency leave is short-term absence leave for employees in Utrecht and throughout the Netherlands in case of acute personal problems, such as a death in the family or a sudden serious illness. The duration is statutorily limited. This article discusses the maximum period, conditions, rights and local authorities in Utrecht.

What is emergency leave and when does it apply in Utrecht?

Emergency leave provides employees with exemption from work in the event of an unexpected calamity with severe emotional or physical impact. Examples:

  • Death of partner, child, parent, sibling, in-law family or close connection.
  • Sudden serious illness or accident of a loved one.
  • Family crisis, such as sudden conflict or relationship breakdown.
  • Acute psychological overload due to trauma.

Statutorily maximum 2 days per calamity, as provided in article 30 of the Work and Care Act (Wet arbeid en zorg - Waz). These days can be taken flexibly, not necessarily consecutively.

Statutory Framework

Key laws:

  • Waz, article 30: Right to leave in case of personal calamity.
  • Civil Code article 7:667a: Protection against sanctions by employer.

The Waz applies throughout the Netherlands, including Utrecht. Employers must honour this, unless a collective labour agreement (cao) provides for deviating (often more generous) rules, such as up to 4 days in various sectors.

Examples of Emergency Leave

Practical cases:

Situation Duration Basis
Death of child 2 days (cao possibly more) Art. 30 Waz
Serious illness of partner 2 days (cao possibly more) Art. 30 Waz
Trauma of employee themselves 2 days (in case of immediate calamity) Art. 30 Waz
Family conflict 2 days (cao possibly more) Art. 30 Waz

Extending beyond 2 days without agreement may result in sanctions. Always notify the employer immediately and document.
